 Empyreal Yacht Charter - Terms and Conditions

1. Reservation and Payment

1.1 Reservation
To reserve a yacht with Empyreal Yacht Charter, the Client must complete the online booking form and agree to the payment terms. A non-refundable deposit is Available to secure a reservation. in this case the client contacts Empyreal Yacht Charter directly to agree and set this up. The deposit is 30% of the total charter price for the duration of the booking charter time. The remaining balance of the total charter price must be paid no later than 5 days before the scheduled trip.

1.2 Payment Methods
All payments must be made in USD and can be made via the payment method specified in the booking process.

2. Cancellation and Rescheduling Policy

2.1 Guest Cancellation

• If the Client cancels more than 5 days before the scheduled charter, a full refund of the total amount paid, minus the non-refundable deposit (if one was paid), will be issued.

• If the Client cancels 5 days or less before the scheduled charter, the Client forfeits the full amount of the charter, and no refund will be provided.

• If a refund is not option due to time of Cancelation, Client may be eligible to reschedule the charter subject to availability and may require a payment of a reschedule fee, if applicable.

2.2 Cancellation by Empyreal Yacht Charter
We reserve the right to cancel the charter if unforeseen circumstances prevent us from providing the yacht. In these cases, we will offer a full refund or reschedule the charter dependant on circumstance. In cases of inclement weather or low tide, we will  work with you to reschedule, (subject to availability).

3. Charter Terms

3.1 Charter Duration
Charters are available for a minimum of two hours with additional durations available as requested by the Client.

3.2 Pick-up and Drop-off
The yacht will be available for pick-up at an agreed pick-up location at the agreed pick-up time. Drop-off will occur at the agreed drop-off location at the agreed drop-off time. Late returns or non-designated pick-up/drop-off locations may incur additional charges.

3.3 Charter Usage
The yacht is to be used exclusively for lawful purposes. Any activities that may damage the yacht or violate local, state, or federal laws are strictly prohibited.

4. Safety and Conduct

4.1 Safety Equipment
The yacht is equipped with all necessary safety equipment as required by law. It is the Captain’s responsibility to ensure that all passengers are familiar with the safety procedures before departure.

4.2 Conduct
The Client and their guests must adhere to the instructions of the Captain and crew. Any behavior that jeopardizes safety or causes damage to the yacht will result in additional charges or the immediate termination of the charter without refund.

5. Liability and Insurance

5.1 Damage and Loss
The Client is responsible for any damage to the yacht or loss of equipment caused by their party. A security deposit may be required and will be refunded within ten working days after the charter, minus any deductions for damage or loss. Any additional charges for damage or loss will be invoiced to the Client.

5.2 Insurance
The yacht is insured for standard coverage. The Client and their guests are advised to obtain their own travel insurance to cover personal belongings, medical emergencies, and trip cancellations.

6. Force Majeure

Empyreal Yacht Charter is not liable for any delays or failures to perform its obligations if caused by events beyond our control, including, but not limited to, natural disasters, strikes, weather conditions, or governmental actions.

7. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Texas, USA. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Harris County, Houston, Texas.

8. Modifications

Empyreal Yacht Charter reserves the right to modify these terms and conditions at any time. Any changes will be posted on our website, and it is the Client’s responsibility to review them before booking.

9. Children’s Life Jacket Policy and Responsibility

10.1 Life Jacket Requirement for Minors
In compliance with Texas state law, all persons under the age of 13 years must wear a U.S. Coast Guard-approved life jacket at all times while on the exterior of the vessel and while the vessel is in motion. It is the responsibility of the Lead Passenger and/or the parents/guardians of minor passengers to ensure this law is followed at all times.

10.2 Captain’s Authority and Enforcement
The Captain is authorized and required to enforce this safety regulation and will insist that all minor passengers wear the appropriate life jacket when on the exterior of the vessel and when the vessel is underway. Should the Lead Passenger or the parents/guardians of a minor fail to comply with the Captain’s instructions, the Lead Passenger and/or the parents/guardians shall assume full responsibility for any resulting consequences.

10.3 Liability for Non-Compliance
Failure to adhere to this safety requirement may result in the immediate termination of the charter, without refund, at the Captain’s discretion. Additionally, the Lead Passenger and/or the parents/guardians may be subject to legal penalties, including fines, for failure to comply with applicable state and federal regulations.

10. Indemnification and Hold Harmless

11.1 Indemnification
The Client agrees to indemnify, defend, and hold harmless Empyreal Yacht Charter, its employees, agents, representatives, and affiliates from all claims, damages, legal costs, and liabilities arising from the Client’s use of the yacht.

11.2 Liability
This includes any personal injury, property damage, or claims made by third parties arising from the Client’s actions, the actions of the Client’s guests or party members, or the operation of the yacht.

11. Public Statements and Content 

12.1 Public Statements and Online Content
The Client agrees not to engage in any public statements, online content, or other activities that promote or imply illegal activities, misinformation, or controversial matters that may negatively affect the reputation or public image of Empyreal Yacht Charter. This includes using the company’s name, brand, or likeness in any media, social media platforms, or public forums in a manner that could be harmful to the brand.

12.2 Liability for Violation
Any violation of this clause will be considered a breach of this Agreement, and the Client will be held liable for any damages resulting from such actions, including reputational damage or loss of business. The Client agrees to cooperate in any corrective actions or legal proceedings if necessary.13.1 Ownership and Use
The use of the yacht under this Agreement does not confer any ownership, partnership, collaboration, or joint venture between the Client and Empyreal Yacht Charter. All rights to the yacht and related services remain exclusively with Empyreal Yacht Charter.

13.2 Content and Reputation
The Client acknowledges that any photos, videos, or content created during the charter, whether for personal or commercial purposes, shall not be used in a manner that misinforms or harms the reputation, brand, or public image of Empyreal Yacht Charter. The Client agrees not to engage in any activity or content creation that could harm the company’s reputation.

13.3 Liability for Harmful Content
If the Client engages in any public statements, online content, or other actions that negatively impact Empyreal Yacht Charter’s reputation or business, they shall be liable for any resulting damages, including reputational harm, financial loss, or legal consequences.

By booking with Empyreal Yacht Charter, the Client acknowledges and agrees to abide by these terms and conditions. The Client further acknowledges that any violations of these terms may result in the immediate termination of the charter and the forfeiture of any funds paid.
